1. Definitions
In these Terms and Conditions, the following definitions apply:
- "Provara" or "we" or "us" means Provara, registered and operating at Unit 5-14, Plaza Sentral, No. 27 Jalan Stesen Sentral 5, 50470 Kuala Lumpur, Malaysia.
- "Programme" means any educational course or session offered by Provara, including the Islamic Finance Concepts Primer, the Islamic Finance Literacy Course, and the Complete Islamic Finance Education Programme.
- "Participant" or "you" means any individual who accesses our website, submits an enquiry, or enrols in a Programme.
- "Content" means all materials, notes, glossaries, concept maps, reference guides, and digital resources produced by Provara and provided as part of a Programme.
- "Agreement" means these Terms and Conditions together with any enrolment confirmation.
- "Website" means the website operated by Provara at its registered domain.
2. Acceptance of Terms
By accessing our Website or enquiring about or enrolling in a Programme, you agree to be bound by these Terms. If you do not agree, please do not use our Website or enrol in our Programmes.
Our Programmes are designed for individuals aged 18 and above. By submitting an enquiry or enrolment, you confirm that you are at least 18 years old and have the legal capacity to enter into this Agreement under Malaysian law.
3. Service Description
Provara provides general educational programmes on Islamic finance principles and concepts. All Programmes are delivered as education only and do not constitute financial advice, investment advice, legal advice or any other form of regulated advisory service.
Content is designed to help participants understand Islamic finance concepts at a general level. Nothing in any Programme should be understood as a recommendation or guidance regarding any specific financial product, investment, or personal financial decision. Participants are consistently encouraged to consult qualified professionals for personal financial decisions.
Programmes are currently delivered from our Kuala Lumpur office. Availability and scheduling are subject to change. We will communicate any material changes to enrolled participants in advance.
4. Enrolment
Enrolment in a Programme is confirmed upon receipt of full payment of the applicable fee. A confirmation will be sent to the email address provided during enquiry or registration.
Provara reserves the right to decline enrolment at its discretion, including where programme capacity has been reached.
Participants are responsible for ensuring the accuracy of personal details provided during enrolment. Errors in contact details may affect our ability to communicate programme information.
5. Participant Responsibilities
As a participant, you agree to:
- Attend sessions punctually and engage respectfully with educators and other participants
- Use Content provided solely for personal, non-commercial educational purposes
- Not record sessions without prior written consent from Provara
- Not distribute, reproduce, or commercially use any Content without Provara's written permission
- Maintain conduct that does not disrupt the learning environment
Provara may remove participants who engage in disruptive or inappropriate behaviour. No refund will be provided in such circumstances.
6. Intellectual Property
All Content, including written materials, concept maps, glossaries, reference guides and digital resources, is the intellectual property of Provara. You are granted a limited, non-exclusive, non-transferable licence to use Content for your personal educational purposes.
You may not copy, reproduce, distribute, publish, sell or otherwise exploit Content without our prior written consent. Sharing of login credentials or digital resources with non-enrolled individuals is not permitted.
7. Fees and Payment
Programme fees are as follows:
- Islamic Finance Concepts Primer: RM 475 per person
- Islamic Finance Literacy Course (5 weeks): RM 1,610 per person
- Complete Islamic Finance Education Programme: RM 3,050 per person
All fees are stated in Malaysian Ringgit (MYR) and are inclusive of all materials described for each programme. Payment is due in full prior to the commencement of the relevant Programme unless otherwise agreed in writing.
Refund policy: Cancellations made more than 14 days before the programme start date are eligible for a full refund. Cancellations within 14 days of the start date are non-refundable. If Provara cancels a session, a full refund or rescheduling option will be offered. Provara reserves the right to adjust fees for future intakes with reasonable notice.
8. Disclaimers
Provara's Programmes are provided as general education. We make no representation that participation in any Programme will produce any particular outcome for any participant.
Content is accurate to the best of our knowledge at the time of delivery but should not be relied upon as definitive legal, financial or regulatory guidance. The Islamic finance landscape is subject to regulatory development; participants should verify current information with qualified professionals.
Provara is not a financial institution, financial adviser, investment manager or legal adviser. Nothing in our Programmes constitutes the provision of regulated services under Malaysian law.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Provara's liability in connection with any Programme or use of the Website is limited to the total fees paid by the participant for the relevant Programme.
Provara shall not be liable for any indirect, special, consequential or incidental loss arising from participation in a Programme or reliance on any Content. This includes, without limitation, loss of income, financial loss, or loss resulting from personal financial decisions made after attending a Programme.
Nothing in these Terms excludes liability for death or personal injury arising from our negligence, fraud, or any other liability that cannot be excluded under Malaysian law.
10. Indemnification
You agree to indemnify and hold Provara, its educators and staff harmless from any claims, losses, liabilities, costs or expenses (including reasonable legal fees) arising from your breach of these Terms, your use of Content in a manner not permitted by these Terms, or your violation of any applicable law.
11. Termination
You may withdraw from a Programme at any time, subject to the refund policy described in Section 7.
Provara may terminate or suspend your participation in a Programme if you breach these Terms. In such cases, refunds will be at Provara's discretion based on the nature of the breach.
Sections 6, 8, 9, 10 and 13 of these Terms survive termination.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising in connection with these Terms or our Programmes shall first be referred to informal resolution by contacting us at [email protected].
If a dispute cannot be resolved informally within 30 days, the parties may refer the matter to mediation under the rules of the Asian International Arbitration Centre (AIAC) before proceeding to litigation. The courts of Malaysia shall have exclusive jurisdiction over any dispute that proceeds to litigation.
13. General Provisions
Entire Agreement: These Terms constitute the entire agreement between you and Provara regarding your use of our Website and Programmes and supersede all prior communications.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
Waiver: Failure by Provara to enforce any provision of these Terms shall not constitute a waiver of the right to enforce it at a later time.
Assignment: You may not assign your rights or obligations under these Terms without Provara's prior written consent. Provara may assign its rights with reasonable notice.
Notices: Formal notices should be directed to [email protected] or to our registered address.
14. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last Updated" date. Continued use of the Website or participation in Programmes after changes are posted constitutes acceptance of the revised Terms. We will notify enrolled participants of material changes by email where practicable.
